1.      June 1, 2013 – Modified Noticing Practice

 

a.       Notices Delegated:

                                                              i.      Notice of Interim Fee Application

                                                            ii.      Notice of Final Fee Application

                                                          iii.      Order re Section 105 status conference

                                                          iv.      Order Approving Notice of Intended Sale

b.      Chart of these  noticing changes published on May 14, 2013 on web site

 

2.      June 3, 2013 – Substantial Changes to Loss Mitigation Program including:

 

a.       New deadline to file request in Chapter 7 cases (60 days from filing)

b.      New attorney fee requirement (up to $2,000 each for debtor counsel and creditor counsel)

c.       New adequate protection payment requirement (31% of gross income)

d.      New status report and consent order forms

 

3.      July 2013 – Change in Procedure for Processing Defective Filings:

 

a.       Minor errors (incorrect party filer, incorrect linkage) to be corrected by Clerk’s office

b.      Major errors (missing signatures, improper service, wrong event used) – document will be terminated and text only event “Corrective Action Required” will enter on docket.  NEF notice only unless debtor is pro se.

c.       Errors related to fee based pleadings – Notice of Defective Pleading will enter with deadline to correct deficiency.

 

4.      July 2013 -  Service Changes

 

a.       Chapter 13 - Movant will be required to serve Continued Hearing Notice on all parties and creditors where court grants motion to continue confirmation hearing.

 

 

5.      September 9, 2013 – Substantial Local Rule and Form Amendments

 

a.       Revised local rules:  1002-1, 1005-1, 1006-1, 1009-1, 2002-1, 2002-2, 2014-1, 2016-1, 3002-1, 3007-1, 3015-1, 3015-2, 3016-2, 3017-1, 4001-1, 4001-2, 4004-1, 4008-1, 5003-2, 5005-4, 5005-5, 5072-1, 5077-1, 5078-1, 5080-1, 5081-1, 7016-1, 7026-1, 9003-1, 9004-1, 9006-1, 9010-1, 9013-1, 9013-2, 9013-3, 9014-1, 9018-1, 9020-1, 9070-1, 9072-1, Appendix IV, Form L.1.

 

b.      Summary Document published and posted on September 9.

 

6.      October 1, 2013 – Local Rule Amendments - Two additional rule changes:   

 

a.       1007-1 – Statement of Social Security Number (Form B21) shall now be filed in all cases as a separate private event. (Bar Notice and instructions posted on 9/30/13).

b.      9010-1 – Pro Hac Vice fees will be paid electronically in ECF rather than by check payable to the Bar Fund (goes into effect 1/1/14).

 

7.      October 18, 2013 – Local Form Changes

 

a.       Form D – was subsequently changed again effective 12/1/13 due to revised federal form changes, see item 9 below.

b.      Form W.1 -  technical one word change

c.       Form W.2 – amended plan changes

 

8.       October 24, 2013 – Notice issued regarding Late Filed Documents– Do not include response language on the Motion to File Out of Time – will be set by the Court.

 

9.      December 1, 2013 – General order amending local rule and form effective Dec 1 to conform with Official form changes (3B, 6I, 6J)

a.       LBR 1006-1 –  requires schedules I and J to be filed with any Application to Waive the Filing Fee

b.      Form D – revised to provide limited supplemental information related to request for fee waiver.

 

10.  December 1, 2013 – Federal rule, Official forms and fee changes:

THE CLERK’S OFFICE WILL BE CHECKING FOR USE OF THE CORRECT FORMS AND ANY FILING ON AN OUTDATED FORM WILL BE TERMINATED AND CORRECTIVE ACTION REQUIRED EVENT ENTERED TO RESUBMIT ON UPDATED FORM.  MAKE SURE YOUR FORMS SOFTWARE IS UP TO DATE!

d.      Fee Changes:

 

New Fee: To Sell Property of the Estate Free and Clear of Liens under 11 U.S.C. § 363(f) - $ 176.00

Record Retrieval Fee (for one box of records from a Federal Records Center, National Archives or other storage location $64.00

Retrieval Fee for each additional box $39.00

Service Charge for any payment returned or denied for insufficient funds (Language has been changed only - No change to fee amount) $ 53.00.
